Huntsville, AL

Will & Estate Attorney

If you are reading this, you need a Will and we can help you.  Let’s do it right the first time and not online — you and your family deserve better. You probably feel the same way I do when I do something significant online and that is “did it work, is it right, will it work, how can I really know?”  That is where we come in, the overwhelming amount of estate planning we see is insufficient in some way — we have had multiple attorneys come to us with faulty Wills and Estates — we are on a mission to get it right for you the first time in way where you are comfortable coming here, confident with all that we do for you, and feel cared for when you leave.

We have seen statistics that a significant majority of Americans, roughly two-thirds (around 68-70%), do not have a will! The primary barriers cited by Americans for avoiding estate planning include:

  • Procrastination: 43% of those without a will report they “just haven’t gotten around to it”.  That was me for 8 years when I was a litigator and before I was an estate planner and saw what the costs would be to my family without one.
  • Perceived Asset Levels: 35% believe they do not have enough assets to justify a will.  Similarly, I was here also but if you have a bank account, home, auto, or retirement, and especially if you are married and/or have children you need a Will.
  • Complexity and Cost: Many believe the process is too expensive (13%) or don’t know how to start (12%).  We can help you with both of these legitimate reasons!  Start here by calling or emailing us.  I can assure you that we are not the most expensive nor are we a cheap fly by night online document mill.

We can help remedy this and so much more and often in a way that is simple and understandable. Let us help you.

Why Estate Planning Matters in Alabama

Without a will or trust, Alabama law—not your wishes—determines who inherits your property (“intestacy”). Estate planning puts you in control not politicians (i.e. government) — instead YOU:

  • Decide who inherits your asset – who gets what and when.
  • Choose your trusted estate manager (usually called an Executor and/or Personal Representative)
  • Protect and secure minor children through guardianship and trust provisions.
  • Minimize court involvement, costs, and taxes.

Why Do We Practice in Estate Planning Law?

Nearly a quarter of century ago I was working in the same building with an Estate Planning Law firm (no longer in business) and saw that they were producing documents (like is done by non-law firm companies online these days) but they didn’t really understand what they were doing, how it worked when it was needed, and didn’t seem to care much about all that — this didn’t not sit right with me.  I was a trial lawyer at the time, and I didn’t know those answers either but thought if we ever do Estate Planning and Wills, I want to be better than that.  Well, here we are and we indeed do much better than that at McCartha Law, LLC, we know what we are doing for you and make it known to you and — it works!  Your Will and Trust are more than paperwork — it is about protecting your family, keeping the government out of your estate, and demystifying the law for you — it is about making it work. Whether your estate is simple or complex, we serve Huntsville and all of Alabama with personalized plans that empower you with confidence and real legal planning.

Wills vs. Trusts: What’s Right for You?

Many families benefit from both a Will and a Trust. A Revocable Living Trust for major assets, plus a “pour-over” or “redundancy” Will (we will explain this nuanced concept to you when we meet) can capture everything else, offer the best protection, privacy, and flexibility.  However, it is important to note that typically only a Will lets you name guardians (custodian) for your children.

For most people, the safest way to begin estate planning is with a Will. In Alabama, a Will acts as a reliable safety net—it covers anything that trusts, or payable-on-death arrangements might overlook. If something isn’t handled by other estate planning tools, your Will ensures it’s protected, so nothing falls through the cracks.

Client Story: Alabama Families, Alabama Values

“The McCartha Law Firm, LLC were very professional and yet personable in creating our necessary legal documents.  They explained in details the requirements between establishing a Will and a Trust.  All of our questions were answered and verified.  My husband and I had recently moved to Alabama but yet still had family out of state.  Alabama Law differs from where we came from in regards to Probate and we feel very much at ease now that we have made our Will’s. We know that the surviving spouse and children will be taken care of.

We highly recommend The McCartha Law Firm!”
